These Terms of Use ("Terms") are a legal agreement between you ("you", "your", the parent or legal guardian) and Devendra Mishra, sole proprietor, trading as lulutells ("lulutells", "we", "us", "our"), governing your use of the lulutells mobile application and any related services (together, the "App").
By downloading, accessing or using the App — and in particular by tapping "I accept" on the consent screen — you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the App.
The App creates personalised, AI-narrated audio stories for children aged 3 to 10, intended to be used together with a parent or guardian. The App is not directed to children for the purpose of forming a contract: only an adult may accept these Terms and operate the account.
To use the App you confirm that:
You are responsible for everything that happens under your account, including any use by your child, and for keeping your sign-in (phone number / OTP) secure.
The App uses your phone number with a one-time password (OTP) to sign you in. You agree to provide accurate information and to keep your device and account secure. You may delete your account at any time from within the App (Settings → Delete Account); deletion is handled as described in the Privacy Policy.
We may suspend or terminate your account if you breach these Terms, misuse the App, or use it in a way that harms other users, us, or our service providers (see Section 11).
Stories are generated and narrated using artificial-intelligence systems based on the few details you provide (your child's first name, age, language and chosen sidekick). Because the content is generated automatically:
If a story contains anything inappropriate, please use the in-app report option or email support@lulutells.com so we can review and improve our safeguards.
The App is for entertainment and family enjoyment only. Stories are not educational, psychological, medical or other professional advice, and should not be relied on as such.
The App offers an optional premium subscription, available as a monthly or yearly auto-renewing plan, and may offer a free trial. The exact price, billing period, and trial length are shown to you in the App at the point of purchase, in your local currency.
All payments are processed by the Apple App Store or Google Play, not by us. Your purchase is also subject to that store's terms. We never receive or store your payment card or bank details.
Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within the 24-hour period before the period ends.
If you start a free trial, you will not be charged during the trial. Unless you cancel at least 24 hours before the trial ends, the subscription will begin and your payment method will be charged automatically. Any unused portion of a free trial is forfeited when you purchase a subscription.
You manage and cancel subscriptions in your app store account settings (Apple: Settings → your name → Subscriptions; Google Play: Play Store → Subscriptions), not by deleting the App. Deleting the App does not cancel a subscription.
Refunds are handled by the app store under its own refund policy. We generally do not provide refunds directly, except where required by applicable law (including your statutory consumer rights, which these Terms do not limit).
We may change subscription prices or plan features. Where required by law or app-store rules, we will give you advance notice and the opportunity to cancel before a price change takes effect.
You agree not to, and not to allow anyone else (including your child) to:
The App, the lulutells name and logo, the sidekick characters, and the software, design and underlying systems are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for the personal, non-commercial enjoyment of your family, in accordance with these Terms.
Subject to your compliance with these Terms, you may listen to and enjoy the stories generated for your family for personal, non-commercial use. You may not sell, distribute, publicly perform, or commercially exploit generated stories or audio. Because stories are AI-generated, identical or similar stories may be generated for other users, and we make no claim that any story is unique to you.
Your use of the App is also governed by our Privacy Policy, which explains what we collect, how we use it, and the strong protections we apply to children's data under COPPA, GDPR/GDPR-K, and India's DPDP Act, 2023. By accepting these Terms you confirm you have read the Privacy Policy and, as the parent or guardian, consent to the limited processing of your child's information described there.
We aim to keep the App available and reliable, but we provide it on an "as available" basis. We may update, change, suspend, or discontinue any part of the App, including stories, characters, or features, and may release features that are in a pre-release or "beta" state and may not work perfectly. We are not liable for any unavailability, change, or discontinuation, except as required by law.
To the fullest extent permitted by law, the App and all content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, or that AI-generated content will always be accurate, age-appropriate, or to your liking. Adult supervision remains essential.
Nothing in these Terms excludes or limits any rights you have under mandatory consumer-protection laws that cannot legally be excluded.
To the fullest extent permitted by law:
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing here limits liability that cannot be limited by law (for example, for death or personal injury caused by negligence, or for fraud).
You agree to indemnify and hold harmless lulutells (Devendra Mishra) from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App, your breach of these Terms, or your violation of any law or the rights of a third party.
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the App. On termination, your licence ends and you must stop using the App; sections that by their nature should survive (including Sections 7, 10, 11, 12, and 15) will continue to apply. Termination does not automatically cancel an app-store subscription — see Section 5.5.
We may update these Terms from time to time. When we make a material change, we will update the version number and effective date above and, where appropriate, ask you to accept the updated Terms in the App before continuing to use it. Your continued use of the App after the changes take effect means you accept the updated Terms. The current version is always available at https://lulutells.com/terms-of-use.html and within the App.
These Terms are governed by the laws of India. The courts of Bengaluru, Karnataka, India have exclusive jurisdiction over any dispute, without prejudice to any mandatory rights you have to bring proceedings or complaints in your country of residence under your local law.
